New Delhi, May 10 : The Central Bureau of Investigation has registered a case against the then DEO, Srinagar; the then SDO-I, DEO, Srinagar; SDO-II, DEO, Kashmir Circle, Srinagar and other unknown public servants/private persons U/s. 5(1)(d) r/w 5(2) of J&K P.C. Act, Svt. 2006 and Section 120-B, 420 of R.P.C.
It was alleged that a huge area of Ministry of Defence land near a sensitive zone in Srinagar was suspected to have been taken by private persons in connivance with officials of Revenue Department of Jammu & Kashmir State and Directorate General of Defence Estates (DGDE), Srinagar.
There was no provision to issue No Objection Certificate (NOC) by the office of DGDE for the purpose of sale/purchase of defence owned or occupied land.
Moreover, as per the existing rules, defence land cannot be alienated to anyone without prior approval.
The said officials of DEO, Srinagar in conspiracy with unknown private persons allegedly issued NOCs to the private persons for the purpose of sale/purchase of defence land measuring 12.25 acres which was either acquired by the Ministry of Defence, Govt. of India or State land of J&K handed over to MoD by the Govt. of J&K.
On the basis of these unauthorisedly issued NOCs by DEO, Srinagar, certain private persons dishonestly & fraudulently managed to execute the sale deeds and attestation of mutation of the defence land.
Some of the private persons had approached DC, Budgam and Court seeking compensation on the basis of sale deed executed against such defence land & attestation of mutation thereof.
Searches were conducted at four places in Jammu, Ambala, Delhi and Patna. Certain documents collected from the office of DGDE, Srinagar Circle and others are being scrutinized.
