Improving the Justice Delivery System in the Countrymaking it affordable and accessible to the common man all across the country. Increasing access by reducing delays and arrears in the system has also been the constant endeavor of the Union Government.
These initiatives of the Union Government inter-alia include measures for strengthening the judicial system, reviewing the strength of the judges from time to time and setting up of part time/special courts, improving infrastructure in the courts and increasing use of ICT for court management as well as for providing citizen-centric services at all levels starting from Supreme Court/ High Courts to the district and subordinate courts. Some of the initiatives are as follows:
The disposal of cases has been accelerated by undertaking special drives, the recent one being from 1st July, 2011 to 31st December, 2011. Of late, the Government has set up a National Mission for Justice Delivery and Legal Reforms which will be addressing the issues of delays and arrears in the judicial system as well enforcing better accountability at all levels through a variety of methods which will include setting and monitoring of performance standard, enhancement of capacity through training at various levels etc.
Fast Track Courts were constituted as per the recommendations of the 11th Finance Commission. For these courts a provision of Rs. 502.90 crore was made for 2000-05. This scheme was extended later till 2010-11. As per the reports received, 1192 fast track courts were functional in the country as on 31.3.2011. Nearly 33 lakh cases were disposed of by the fast track courts over a period of 11 years of central assistance from 2000-01 to 2010-11.
The 13th Finance Commission has recommended a grant of Rs.5,000 crore for the states over a period of 5 years between 2010-2015. The amount will be provided as a grant to the States for various initiatives such as:
(i) Increasing the number of court working hours using the existing infrastructure by holding morning / evening / shift courts;
(ii) Enhancing support to Lok Adalats to reduce the pressure on regular courts;
(iii) Providing additional funds to State Legal Services Authorities to enable them to enhance legal aid to the marginalized and empower them to access justice;
(iv)Promoting the Alternate Dispute Resolution (ADR) mechanism to resolve part of the disputes outside the court system;
(v)Enhancing capacity of judicial officers and public prosecutors through training programmes;
(vi) Supporting creation or strengthening of a judicial academy in each State to facilitate such training;
(vii) Creation of the post of Court Managers in every judicial district and High Courts to assist the judiciary in their administrative functions; and
(viii) Maintenance of heritage court buildings.
An amount of Rs. 1,353.623 crore has already been released to the States on this account.
Under the central sector scheme of Computerization of the District and Subordinate Courts (e-Courts Project) in the country and for up-gradation of the ICT infrastructure of the Supreme Court and the High Courts, a total of 9,914 courts (out of 14,229 courts) have been computerized in the country as on 31.03.2012. Remaining courts will be computerized by 31.3.2014. In the second phase, digitization, library management, e-filing and establishment of data warehouse are expected to be added to the ongoing computerization and citizen-centric services.
The Gram Nyayalayas Act, 2008 has been enacted for establishment of Gram Nyayalayas at the grassroots level for providing access to justice to citizens at their doorstep. The Central Government is providing assistance to States towards non-recurring expenses for setting up of Gram Nyayalayas subject to a ceiling of Rs. 18.00 lakh per Gram Nyayalaya. The Central Government also provides assistance towards recurring expenses for running these Gram Nyayatayas subject to a ceiling of Rs. 3.20 lakh per Gram Nyayaiaya per year for the first three years. As per the information received from the State Governments a total of 153 Gram Nyayalayas have already been notified so far. Out of these, 151 Gram Nyayalayas have already started functioning. An amount of Rs. 25.39 crore has been released to the State Governments for establishment of Gram Nyayalayas during last three years.
A Centrally Sponsored Scheme for development of infrastructure facilities for the judiciary is being implemented since 1993-94 under which central assistance for construction of court buildings and residential quarters for judicial officers is released to augment the resources of the State Governments.
The expenditure on the scheme is shared by the Centre and the State Governments on 75:25 basis, except for States in North East Region, which is on 90:10 basis. An expenditure of Rs. 1,841 crore has been incurred on this scheme up to 31.03.2012. For legal empowerment of the marginalized people in India an externally aided Project ‘Access to Justice for Marginalized People in India’ is being implemented in the selected 7 States, with the support of UNDP.
These 7 States are: Bihar, Chhattisgarh, Jharkhand, Madhya Pradesh, Orissa, Rajasthan and Uttar Pradesh. The interventions under the Project are focused on strengthening access to justice for the poor, particularly women, Scheduled Castes, Scheduled Tribes, and minorities. The Project seeks, on the one hand, to improve the institutional capacities of key justice service providers to enable them to effectively serve the poor and disadvantaged. On the other hand, it aims to directly empower the poor and disadvantaged men and women to seek and demand justice services.

IMPHAL, May 2: A team of Supreme Court Commissioners are presently in the state to attend a meeting with state government authorities in relation to Supreme Court WP (C) No 196/2011 on implementation of food and employment related schemes including ICDS, MDMS, NREGA, NOAPS, TPDS, NMBS, JSY and NFBS in the state.

The meeting will be chaired by the state Chief Secretary DS Poonia on May 3 at 11am at the conference hall of the Manipur Secretariat, North Block. Imphal. May 2 NNN : Civil societies in and around the area of Jessami village in Ukhrul district of Manipur and Meluri in Phek district of Nagaland will hold a meeting on Thursday to bring about an amicable solution to the recent flare up of trouble between the villagers of the two border villages.
The meeting which is reportedly organized by Tangkhul civil organizations and civil organizations on the Nagaland side will endeavor to bring a cordial agreement regarding the land dispute between the two villages according to the customary law of the Nagas.
The two villages, Jessami in Ukhrul district, Manipur and Meluri in Phek district, Nagaland have been facing land dispute trouble from time to time since a long time back with villagers claiming land ownership across the state boundary in both sides which has led to several fracases between the villagers of the two villages.
It is hoped and believed that the meeting on Thursday between civil society organizations from both the states will be able to bring about an amicable solution to the problem once and for all.
In the meantime, the police station at Jessami has been reported to be upgraded to the status of SDPO where additional strength of 70 police personnel will be added and 100 Manipur Rifles (MR) personnel will also be posted, said official source.
So far, only 75 Manipur Rifles personnel has reached Jessami till now, and the remaining personnel will reach their destination at the earliest possible time, added the official source.
Restriction under CrPC 144 is still being imposed in the state boundary on either side of the two villages since April 21 to prevent any further flare up of trouble at the disputed sites, where the recent trouble started with the abduction and assault of six villagers of Jessami by villagers of Meluri on April 18.

Imphal, May 2: The Minister of HRD, Communications & IT, Shri Kapil Sibal has expressed his deep concern on the recent incidents of alleged discrimination and profiling of students from the north-eastern region pursuing their studies in educational institutions. Shri Sibal had last month requested UGC to formulate regulations to prevent discrimination in higher educational institutions. UGC in its meeting on 2/4/12 has deliberated on these Regulations and has finalized them. Every institution is required to establish an Ombudsman who would have the power to hear complaints of discrimination in institutions.
Shri Sibal felt that educational institutions should rise to the occasion to provide an inclusive and harmonious platform for students from across the country to come together and pursue studies.
Karnataka Chief Minister D SadanandaGowda has ordered the police to register an FIR in death case of Manipuri Student Loitam Richard. The order came after Sunil Deodhar, national convener of BJP’s North east India Sampark Cell, called on Gowda Monday night demanding a through investigation in the case. Gowda assured Deodhar that the investigation will be foolproof and there will be no loopholes. The Inspector General of Police (Intelligence), GopalHosur has asked the local S.P. to file a case of murder against unknown persons.
As a fallout of unrest in North Eastern population across the country in the case of death of a Student from Manipur, Richard Loitam, Shri Sunil Deodhar rushed to Bengaluru yesterday for timely intervention. North East India SamparkCelll is formed with specific object of providing helpline to the north eastern people in the rest of India.
Sunil Deodhar along with Omprakash (President, Manipuri Meitei Association Bengaluru) and Tiken (President, Manipuri Students Association Bengaluru) also met the Karnataka State home minister R. Ashoka and requested him to look in to the matter seriously. Home Minister assured immediate action once the forensic report is received which is expected within one week.
There is a view in media that this is a case of racism but Deodhar does not subscribe to this view. He asserted that one should wait for forensic report and completion of investigation by police before coming to any conclusion.
Richard Loitam a Manipur student was found dead in his hostel room on 18th of this month. He was a student of B. Arch (1st year) at Acharya College, Bengaluru. The circumstances under which he was found dead were mysterious and needs investigation.
The immediate action and support by the BJP’s cell has given some solace to the parents of the victim in particular and the Manipuri migrants in the city.

IMPHAL, May 2: As celebrated around the world, International Labour Day as known as May Day was also celebrated in Manipur by the Joint Administrative Council of All Manipur Trade Unions (AMTUC) and All Manipur Govt Employees Organization (AMGEO) and also by the Manipur Domestic Workers’ Movement Organization.   

In releases of the JAC of AMTUC and AMGEO said that the JAC has celebrated May Day at its office at Babupara with the attendance of the executives of the JAC, representatives of other departments, Manipur state pensioner Union executives and pensioners.

In another release of the Manipur Domestic Workers’ Movement Organization (MDWMO) said that domestic workers from different parts of Manipur gathered together on May 1, 2012 and celebrated the achievements of the domestic workers movement in general, and commemorated all those who have given so much in the cause of justice, equality and human dignity.

It also said that MDWMO marked the day at DSSS hall, Mantripukhri, Imphal under the theme “Decent work for Domestic workers”.  Around 200 Domestic workers and children of domestic workers took active participation, it added.

IMPHAL, May 2: The state government has approved the detention order of two individuals including a woman under the National Security Act recently, said a source.

It has informed that the state government after minutely considering the grounds for detention furnished by the District Magistrate of Imphal West for both the individuals approved the order of detention.

The two are identified as Tongbram (n) Leichonbam (o) Binarani Devi alias Eche, 37 wife of L Dhanabir Singh alias Dhana alias Ibai of Singda Kadangband Part I, under Imphal West and Leiphrakpam Gopen Singh alias Khangba alias Roshan, 32 son of (L) L Biren Singh of Langthabal Phuramakhong, Singjamei.

Gopen is identified to be a member of the People Liberation Army (PLA/CORCOM).

IMPHAL, May 2: The Chingai Block Congress Committee has appealed to all the concerned higher authorities to exempt the beneficiaries in the hill areas particularly Ukhrul district from the subsequent guidelines for opening bank account for all the beneficiaries in regard to the old age pension and assistance to the widows and physically handicapped person.

A release of the committee said that 90 percent of the beneficiaries are from far flung villages where there is no proper road communication and also the beneficiaries being aged, disabled and widowed, it is not practicable to come to the district HQ (which has only two banks) to draw the said scheme.

Further, the committee has also appealed the concerned authorities to look into the matter regarding irregularities in distributing of essential commodities under PDS in Ukhrul district and ensured immediate steps necessary to initiate in delivering of rice and SK oil for the people living Below Poverty Line.

A release of RKL said that Ukhrul district has been neglected in all aspects for over a decade due to absence of Cabinet Ministers and yet Ibobi continues to have his eye on the district as a target of discrimination.

Further it also said that the uneven distribution of Cabinet Posts has led Ukhrul district face the same fade as that of past. The recent incidents of disappearance of children once again bring to focus, the issue of child recruitment in the state. In recent times, recruitment of children in the ranks of insurgent groups had come down due to public pressure against such episodes. Several children were released after massive protests in the valley. Yet, the issue has once again raised its ugly head, which has again led to protests from various student bodies and civil society organizations. Subsequently, three children from Sairem Khun of Imphal West and a Don Bosco student were released after disappearing for several days. One thing is certain, groups wherever they are ultimately bent to public pressure. But, we should not remain silent over these happenings and a widespread debate has become the need of the hour. The three children from Sairem Khun were allegedly recruited through a relative of one of the boys and subsequently released at Moreh. This speaks volumes. More recently, Rahul Takhellambam of Don Bosco School Chingmeirong showed up near Chandel Bazar in delirious condition. There were reports of a KCP faction demanding a ransom of Rs 3 lakhs to Don Bosco authorities, according to frontline student organizations. Meanwhile, a few insurgent organizations have denied their involvement in cases of child recruitment. Yet, a pro-active action on the part of insurgent organizations to stop incidence of child recruitment is yet to be seen. Here, we have to remember that, we always seem to neglect the involvement of the state with regard to recruitment of child soldiers. According to the Child soldiers Global Report 2008, the number of governments that used children in armed conflict only marginally declined – down from 10 in the period 2001-2004 to nine in 2004-2007. In Myanmar, boys below the age of 18 continued to be forcibly recruited into the army in large numbers and were used in active combat as well as other roles. India is among 14 governments which also recruited, and in some cases used in hostilities, children in auxiliary forces, civilian defence groups or in illegal militias and armed groups acting as proxies for official armed forces. The report further says, dozens of armed groups in at least 24 countries have recruited under-18s and many have used them in hostilities. In India, child recruitment by Maoist groups is reported to have increased since 2005 and there were persistent reports of child soldier use by groups in Jammu and Kashmir and northeastern states. In the Philippines and Myanmar children are associated with armed groups involved in protracted low-level conflicts with state forces. In other situations, such as India, Myanmar and Thailand, no arrangements existed to facilitate the release of children from armed groups or to assist their reintegration. In a number of countries children suspected of involvement in armed groups have been arbitrarily detained and some were reported to have been subjected to ill-treatment or torture. In India, there was evidence that in areas of armed conflict children were detained, often in violation of national legislation designed to protect children. India is also one country which uses captured, surrendered or escapees from armed groups as spies, informants or messengers. The UN Security Council in July last year unanimously adopted a resolution against recruitment of child soldiers, pressing nations to halt the abuse of children including rape and attacks on schools. In its report on child soldiers in 2010, the United Nations for the first time named military forces and rebel groups that persistently used children in armed conflict. The groups included Myanmar`s national army and two rebel militant groups in the country; three insurgent groups in the Philippines; the Revolutionary Armed Forces of Colombia; armies and militias in the Democratic Republic of Congo; and pro-government militias in Sudan as well as the southern-based Sudan People`s Liberation Army.

As per existing policy the North-Eastern States, Jammu and Kashmir and Himachal Pradesh are required to bear only 10% of the cost of deployment of Central Armed Police Forces in their States. Therefore the North Eastern States, J&K and Himachal Pradesh already have been given sufficient relief compared to the other States who are required to bear the full cost of deployment
This was stated by Shri Jitendra Singh, Minister of State of Home Affairs in written reply to a question in the Rajya Sabha today.
At present, there is no proposal to raise tribal battalion for Left Wing Extremism (LWE) affected States. However, recruitment of constables (General Duty) in Central Armed Police Forces (CAPFs) is being done through Staff Selection Commission, wherein 20% vacancies in Border Guarding Forces and 40% vacancies in forces other than Border Guarding Forces are allotted to militancy affected areas, including LWE affected areas.
The Government had sanctioned the construction of fencing along the IBB in two phases. The total length of Indo-Bangladesh border sanctioned to be fenced under Phase-I and Phase-II is 3436.59 km; out of which about 2760.12 km of fencing has so far been completed. In addition, the Government of India has sanctioned a project (Phase-III) for replacing the entire fencing constructed under Phase-I. So far, 790 km (out of 861 km) of fencing has been replaced under Phase-III.
277 km of floodlighting has been completed in West Bengal as a pilot project. The Government has decided to undertake additional floodlighting in 2840 km along Indo- Bangladesh border. The work of floodlighting in new border areas for a length of 1015 km has been completed of which 757 km has been energized. Additionally, in about 612 km of floodlighting work is under progress at different stages i.e. erection of poles, laying of cables, fitting of fixtures and energization.
As per the present approval, the above works were targeted to be completed by March, 2012. However, this has spilled over as the balance work lies primarily in difficult stretches and involve issues like land acquisition, public habitation, forest! wildlife clearance, fencing within 150 yards of international border etc.
The Government has sanctioned 2043.63 km of border fencing and 2009.52 km of floodlighting along the IPB; out of which 1953.50 km of border fencing and 1900.92 km of floodlighting has been completed.
As per the present approval (accorded on 20.07.2009), the above works are targeted to be completed by March‘ 2012 or three working seasons. However, this is likely to spill over as the balance work involves the difficult areas of the Rann of Kutch in the Gujarat sector.
Expenditure incurred/sanction issued are more than the allocated funds as sanctions were issued based on the BE while the allocation was revised downwards at RE stage later.
This was stated by Shri Mullappally Ramachandran, Minister of State of Home Affairs in written reply to a question in the Rajya Sabha today.

Itanagar, May 2 (ANI): The Indian Army’s 1st Arunachal Scouts battalion, two years after its formation, has taken charge of providing security to the unmanned, inhospitable and porous international border in the land-locked Himalayan state.
The battalion will help to maintain peace and tranquility in the border areas, and will not only be eyes and ears, but also act as a force multiplier.
Arunachal Scouts is an infantry regiment with specialization in mountain warfare and was raised to defend India’s border with Tibet in Arunachal Pradesh.
Arunachal has the longest international boundary among the states in the country with 1,680 km – 160 km with Bhutan, 1,080 with China and 440 km with Myanmar.
Led by commanding officer in the rank of a colonel, the battalion reached its headquarters at Riyang on Sunday, 30 km from Pasighat, to do the most onerous duty – assisting Arunchalees, who have been serving as sentinels of the eastern frontier of the nation since the army suffered a humiliating defeat at the hands of the Chinese in 1962.
The new battalion is born out of the Assam Regiment and will continue to be a part of the living symbol of martial strength and traditions of the Northeast.
Local recruits of the new force having inborn qualities will go a long way in ensuring the national integrity and will take the mantle of the other jawans to maintain vigilance in places that have varying altitudes from 1,500 feet to 2,400 feet of altitude from the sea level.
The proposal to raise the Arunachal Scouts along the lines of the illustrious Ladakh Scouts for defending the border with China was proposed by Governor J.J. Singh, a former army chief in 2008, who had pushed the proposal through Prime Minister Manmohan Singh. The Union Cabinet approved the proposal in 2009 and the 1st battalion was raised in 2010.
Chief Minister Nabam Tuki, who has been putting his weight behind the sanction of 2nd Arunachal Scouts Battalion, was the happiest man, when Defence Minister A.K. Antony announced its sanction in his address during the statehood Day celebration at Indira Gandhi Park here on February 20.
In fact, Antony had assured Arunachal Pradesh about raising three additional Arunachal Scouts Battalions with full preference to local youths. He had given this assurance when a delegation comprising of late Chief Minister Dorjee Khandu, Member of Parliament Takam Sanjoy along with high-ranking officials had called on him at his New Delhi office on July 9, 2010.

He felt bad for the woman but more than that this incident raised several questions in his mind. What for is he an engineer if he cannot devise an implement that could help lessen the burden of these people. He started thinking of ways on how this could be done. Then he saw an advertisement from the National Innovation Council which called for proposals on models that could reduce the drudgery of the workers. This gave him an incentive to start working on what he had been thinking ever since he saw the woman labourer break her toes. Finally he was able to design a vessel desk. Bricks and other material could be put in this vessel and the light desk to carry it was so designed that it distributed the burden on the two shoulders instead of the whole weight falling on the head. Also there was no question of losing the balance with this implement. He sent the design to National Innovation Council. His model was selected for the award which carried a cash prize of 50,000 rupees. The vessel desk can be used by both men and women.
Raghunath has also designed different kinds of attachments to go with the model for use separately by farmers or other workers to reduce their drudgery. Also the model suits the Indian conditions. Raghunath says that it cost him between 700 to 800 rupees to make this model. He feels that the model can be improved upon and produced on a large scale for use by construction workers.
We often see women young and old carrying loads of bricks and other construction material on their heads or men carrying huge sacks of food grains and other stuff or these people breaking stones at construction sites in severe weather conditions risking all kinds of injuries. Also we see men with bare bodies getting into manholes to clean sewers without any safe guards or proper implements. While science and technology in our country has advanced by leaps and bounds very little thought has gone into manufacturing simple and low cost implements that could reduce the risks of injury, pain and physical burden and drudgery of the working class.
These questions had bothered him says Sam Pitroda, the Chairman of the National Innovation Council.
Mr. Pitroda says that attention has for too long been focused on the problems of the rich and there was a need for Indian model of inclusive innovation that focused on the poor and the common man.
The Council therefore decided to make a beginning by the launch of ‘The Challenge’ last year seeking innovative ideas in the areas of design improvement of work implements, new equipment, techniques for different kind of workers to reduce their drudgery. The challenge was not only to work on implements, processes, and models that could improve work conditions, but these innovations should not lead to labour displacement.
More than 450 proposals and designs of models were received this year. Six of them were selected for the first ever innovation awards of this kind. Among the six winning innovations was a low cost cycle for the physically challenged. Although in the developed countries, the physically challenged are not dependent on others because they have different kinds of aids that help them in coping with their day to day life. In our country unfortunately even simple gadgets have either not been devised or made available to the physically challenged to make their life less dependent on others.
The proposal came from three young men from Chennai. The Cycle is for the disabled without hands.
What motivated them to work on this model?
Once when the three young men Mahesh PV, Ajith T Alex and Anand Ganesh were travelling they saw a one-handed person getting into the bus with great difficulty. That time they took the decision that some transportation facility has to be made for reducing the difficulty of a handless person. Then during a brain-storming session they decided to start working on a cycle that could be driven by people who lost their arms and hands. This cycle is not only cost effective but eco-friendly as well.
The three young men are now continuing their talks with the government for further expansion to reach the needy and reducing their difficulty and dependence on others.
Their challenge now is to work on a cycle that could be driven by a physically challenged person who does not have either hands or feet.
Manjunath’s display Unit for small Hawkers and Street Vendors was also selected for the award.
Manjunath was already working on Street vendors in his Master’s thesis Projects. So he could use the case study of his thesis the Post Your Ideas Program by National innovation council.
This model is for Direct and semi-processing retail products. There are some limitations like the size of the products but it is transformable furniture and can be moved quickly and easily. It’s handy and can be moved from one place to another without any difficulty. The material used to make the product can be recyclable plastic. The idea behind his model is also to save the space which is shrinking with increasing population
Jitendra Das, former Asst Engineer with KMC Kolkata says that all his life he had been seeing the workers getting into manholes and cleans sewerages and that is why he created the model of a picking
Grab for sanitation workers without exposing hands.
The ideas generated by this first innovation challenge says the Council is just a starting point to involve the wider community to solve the problem of the bottom of the pyramid. What the chairman the National Innovation council wants is a legislation focused on dignity of labour. He says that to start with at least at the construction sites of projects that are funded by the government, the workers should be provided with facilities like portable toilets and implements like wheel barrow.
The council has taken the first step to provide dignity to labour by the launch of the innovative challenge for implements to reduce the drudgery of the workers, the onus is now on the polity of the country to ensure through laws that every worker in the country gets at least minimum basic amenities and are given the dignity they truly deserve.
