New Delhi, Aug 29: The Special Judge for CBI Cases, Guwahati(Assam) has convicted Indrani Bhattacharjee, the then SB Counter Postal Assistant, Ulubari Sub Post Office, Guwahati; Paresh Ch.Deka, the then SB Counter Postal Assistant, Paltanbazar Sub Post Office, Guwahati and Braja Kanta Kalita, an Agent(a private person) resident of Kamrup(Assam) U/s 120B, 420, 468, 471 IPC & Section 13(2) r/w 13(1)(d) of PC Act, 1988. Braja Kanta Kalita was sentenced to undergo three years Rigorous Imprisonment with fine of Rs.10,000/- each in two cases. Indra Bhattacharjee and Paresh Ch.Deka, both were sentenced to undergo three years Rigorous Imprisonment with fine of Rs.50,000/- each in one case. Braja Kanta Kalita is the common accused in both the cases.
The First case was registered on 29.01.1998 U/s 120B/420 IPC & Section 13(1)(d) of PC Act, 1988 against the then Sub Post Master, Ulubari, Sub Post Office, Guwahati; Braja Kanta Kalita, an Agent(a private person), resident of Kamrup and unknown private persons on the allegations of criminal conspiracy in opening of six S.B.accounts in fictitious name, depositing of six cheques/dividend of UTI and other financial institutions amounting to Rs.1,56,200/-(approx) in the said fictitious accounts and subsequent withdrawal of the same.
On completion of investigation, chargesheet was filed on 23.07.2001 in the Court of Special Judge, CBI, Assam, Guwahati against Braja Kanta Kalita, an Agent(a private person) and Indrani Bhattacharjee, the then SB Counter Postal Assistant, Ulubari Sub Post Office, Guwahati U/s 120B, 420, 468, 471 IPC & Section 13(2) r/w 13(1)(d) of PC Act, 1988.
The Second case was registered on 29.01.1998 U/s 120B, 420 IPC & Section 13(2) r/w 13(1)(d) of PC Act, 1988 against then then Sub Post Master, Paltan Bazar, Guwahati; Braja Kanta Kalita, an Agent (a private person), resident of Kamrup and other unknown private persons on the allegations of criminal conspiracy and thereby opened six fictitious SB accounts, deposited certain cheques/dividends of UTI & other financial institutions amounting to Rs.2,22,009/-(approx) and subsequently withdrawn the same. The cheques sent through registered post were never reached to the actual policy holder.
After completion of investigation, chargesheet was filed on 23.07.2001 in the Court of Special Judge, CBI, Assam, Guwahati against Braja Kanta Kalita, an Agent(a private person), resident of Hahdia, Kamrup(Assam) and Paresh Ch.Deka, the then SB Counter Postal Assistant, Paltan Bazar Sub Post Office, Guwahati U/s 120B, 420, 468, 471 IPC & Section 13(2) r/w 13(1)(d) of PC Act, 1988.
The Trial Court found the accused persons guilty and convicted them.
